HIALEAH, Fla. – Italian case goods supplier Fabelli has sued fellow case goods company Edgar’s Furniture Manufacturing for allegedly copying one of its bedroom styles. Both companies specialize in contemporary bedroom furniture and are located just outside of Miami.
Fabelli alleges Edgar’s Barcelona bedroom set is a copy of the company’s own Viola White Lacquer bedroom set launched in 2020. Fabelli says it has suffered damage and injury to its business as a result, causing lost revenue and profits.
Fabelli also alleges the Barcelona set is of inferior quality, causing the retail market to become predisposed against the design of Fabelli’s Viola set. It alleges that one of its retail customers no longer wants to sell the Viola set for this reason. The Barcelona set is being sold in lower-end furniture stores in Miami, “effectively ruining the market for Fabelli’s higher-end product because it was deficiently copied,” according to the suit. “Defendants used the design in a way that was likely to deceive and confuse consumers as to the source of Edgar’s 2023 Barcelona bedroom set and to compete unfairly with Fabelli’s sale of its bedroom set, harming plaintiff’s reputation and goodwill by causing consumers to believe, incorrectly, that Barcelona was made, designed, manufactured, sold by, or somehow associated with or related to, Fabelli.”
Fabella is seeking disgorgement of all profits derived from Barcelona sales, lost future profits, the value of unsold inventory, attorney fees and an end to the sale of the Barcelona. The company is seeking a trial by jury.
Edgar’s did not wish to comment at this time.
